Double Jeopardy
Over two deoxycytidine monophosphate years ago our forefathers wrote our Bill of Rights. The 5th Amendment deals with what was called Double Jeopardy, and it guarantees that, no person shall be subject for the same offense to be twice put in risk of infection of life or limb (Wiet 1996). The Supreme Court has established Double Jeopardy falls into three categories. The first category is It protects over against a scrap prosecution for the same offense after an remission. Second, it protects from a guerilla prosecution for the same offense after a time. Lastly, it protects against threefold punishments for the same offense (Weikart 1998). It should be noted that double jeopardy only applies to criminal founts and not civil suits (Weikart 1998). America is the close litigious nation on the planet (Hutchinson). In invigorated York City alone, more than a million lawsuits are filed yearly for every imaginable type of criminal and civil spoil (Hutchinson). People are sue happy, and are using the civil courts to get a mix of justice, revenge, and recompense for the violent finish and suffering of a loved one (Hutchinson).




Where the argument lies is in the first category. Should an alleged criminal be tried again if overwhelming evidence is found that would overturn an earlier acquittal?
